Terms of Service

1. Acceptance of these terms

These Terms of Service (the “Terms”) form a binding agreement between you and Beijing Jingrui Yuetao Technology Co., Ltd (“Jingrui Yuetao”, “we”, “us”, “our”). By installing, accessing or otherwise using any of our websites, mobile applications, support channels or services (collectively, the “Services”), you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree with any part of these Terms, you must not install or use the Services, and you should promptly uninstall any Jingrui Yuetao application you have already installed.

2. Eligibility and accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Services. If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

Most of our Services do not require you to create an account. Where an account is required (for example, to manage a subscription or to access cloud backup), you agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity that occurs under your account.

3. Licence to use our apps and services

Subject to your compliance with these Terms and your continued payment of any applicable fees, Jingrui Yuetao grants you a limited, non-exclusive, non-transferable, revocable licence to install and use one copy of each Jingrui Yuetao application, in object code form, on a device that you own or control, solely for your personal, non-commercial use (or for the internal business use of the organisation you represent).

The licence is conditional on your compliance with Section 5 (Prohibited uses). We may add new features, modify existing features, or remove features at any time, in our reasonable discretion, as set out in Section 10.

4. Your content and your data

You retain all intellectual property rights in the content you create using our apps — for example, your saved routes, your catalogue entries, your written snippets, your training logs, your scanned receipts and your habit records (collectively, “Your Content”). Because our apps are designed to keep Your Content on your device, we do not need a licence to host or back up Your Content: it is not on our servers in the first place.

Where you voluntarily share content through a feature that explicitly publishes to a third party (for example, exporting a GPX file to a partner service, or sharing a habit summary as an image), you alone are responsible for that content and for ensuring you have the right to share it. We are not responsible for the use of Your Content by any third party once you have shared it.

5. Prohibited uses

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any Jingrui Yuetao application, except to the extent expressly permitted by applicable law.
• Modify, adapt, translate, or create derivative works of the Services, in whole or in part.
• Rent, lease, sublicense, distribute, or otherwise transfer the Services to any third party.
• Remove, alter or obscure any copyright, trademark or other proprietary notices contained in the Services.
• Use the Services to violate any applicable law, regulation or third-party right.
• Use the Services to upload, store or transmit malware, ransomware, viruses, worms, time bombs or any other harmful code.
• Attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Services or the networks or systems connected to them.
• Use any automated means (bots, scrapers, crawlers) to access the Services except for legitimate search engine indexing of our public website.
• Use the Services in any manner that could disable, overburden, damage or impair the Services or interfere with any other party’s use of the Services.

6. In-app purchases, subscriptions and refunds

Some of our apps offer paid features or auto-renewable subscriptions (collectively, “IAP”). All IAP transactions are processed by the Google Play Store or Apple App Store, and are subject to the respective store’s terms and refund policy in addition to these Terms. Jingrui Yuetao does not have access to, and cannot store, your payment card details.

Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the end of the cycle. You can manage or cancel a subscription from your Google Play or Apple App Store account settings at any time. Cancellation takes effect at the end of the current billing cycle.

Free trials, where offered, convert to paid subscriptions automatically at the end of the trial unless cancelled. Eligibility for a free trial may be limited by the app store (for example, Google Play may restrict trials to first-time subscribers on a per-account basis).

Refunds are governed by the refund policy of the relevant app store. We may, at our sole discretion and where the store permits, issue goodwill refunds on a case-by-case basis.

7. Advertising

Our free-tier apps display advertising (In-App Advertising, or “IAA”) through our ad mediation partners. The list of mediation partners, the categories of data they may receive, and the ad formats we use are described in detail in our Privacy Policy.

You may opt out of personalised advertising by toggling off “Personalised ads” in the app’s settings screen, or by resetting your device’s advertising ID through your operating system settings. Opting out does not remove ads; it only stops them from being tailored to your inferred interests.

8. Intellectual property

All intellectual property rights in the Services, including but not limited to software, designs, illustrations, photographs, trademarks, logos, brand names, copy and audio (collectively, “Jingrui IP”), are owned by Jingrui Yuetao or its licensors. Nothing in these Terms transfers any ownership in the Jingrui IP to you. You may use the Jingrui IP only as expressly permitted by these Terms.

“Jingrui Yuetao” and the Jingrui Yuetao logo are trademarks of Beijing Jingrui Yuetao Technology Co., Ltd. You may not use these marks without our prior written permission, except as necessary to identify our products in honest, accurate reviews or commentary.

9. Third-party services and open source

The Services may contain links to, or interoperate with, third-party websites, services or software (for example, Google Play Billing, Apple App Store, mapping providers, OCR engines). Jingrui Yuetao does not control, and is not responsible for, any third-party service. Your use of any third-party service is at your own risk and is subject to that third party’s own terms and privacy notice.

Our apps incorporate open source software components. A complete list of open source components and their respective licences is available within each app’s “Acknowledgements” or “Open Source Licences” screen, and is incorporated into these Terms by reference.

10. Availability, updates and changes

We work hard to keep the Services available and bug-free, but we cannot guarantee that the Services will be uninterrupted, error-free or free from data loss. We may perform scheduled or emergency maintenance, during which the Services may be temporarily unavailable.

We may release updates that add features, fix bugs, improve security, or remove features that are no longer viable. Some updates may be mandatory (for example, a critical security patch); others may be optional. We may, at our discretion, discontinue a particular Service at any time. Where reasonable, we will give advance notice of discontinuation through the app, our website, or your registered email address.

11. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, with all faults and without warranty of any kind. Jingrui Yuetao and its licensors expressly disclaim all warranties, whether express, implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Without limiting the foregoing, Jingrui Yuetao makes no warranty that the Services will meet your requirements, operate without interruption, achieve any particular result, be compatible with any particular device or operating system, or be free from harmful components.

12. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Jingrui Yuetao, its affiliates, officers, directors, employees, agents, licensors or partners be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to damages for loss of profits, revenue, goodwill, use, data or other intangible losses, arising out of or in connection with your use of, or inability to use, the Services, regardless of the legal theory and even if Jingrui Yuetao has been advised of the possibility of such damages.

In any event, the aggregate liability of Jingrui Yuetao for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you actually paid to Jingrui Yuetao for the relevant Service in the twelve months preceding the claim, or (b) one hundred US dollars (USD 100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to defend, indemnify and hold harmless Jingrui Yuetao and its affiliates, officers, directors, employees, agents, licensors and partners from and against any claims, damages, obligations, losses, liabilities, costs or expenses (including reasonable attorneys’ fees) arising from (a) your access to or use of the Services, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any claim that Your Content caused damage to a third party.

14. Suspension and termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if (a) you breach these Terms, (b) your use of the Services poses a security or legal risk, (c) we are required to do so by law, regulation or a store policy, or (d) we decide to discontinue the relevant Service in accordance with Section 10.

You may terminate these Terms at any time by uninstalling all Jingrui Yuetao applications and ceasing use of the Services. The provisions of Sections 4 (your content), 8 (IP), 11 (disclaimer), 12 (limitation of liability), 13 (indemnification), 15 (governing law) and any other provisions that by their nature should survive termination shall survive any termination.

15. Governing law and dispute resolution

These Terms are governed by the laws of the People’s Republic of China, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in Beijing, in accordance with its then-current arbitration rules. The arbitration award shall be final and binding.

Nothing in this section prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction to prevent irreparable harm.

16. Changes to these terms

We may update these Terms from time to time. When we make a material change, we will notify you through one or more of the following means: an in-app banner, a notification on this website, or an email to the address associated with your support correspondence (where you have provided one).

The “Last updated” date at the top of these Terms reflects when the most recent change took effect. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
